Right to asylum

The Assembly,

1. Referring to its Recommendation 1088 (1988) on the right to territorial asylum ;
2. Considering that, in recent years, there have been numerous cases of persons seeking refuge in diplomatic premises of Council of Europe member states ;
3. Considering that there are numerous and delicate problems in respect of such refugees ;
4. Concerned about the difficult situation many asylum-seekers face when arriving by air in a member state of the Council of Europe,
5. Instructs its Legal Affairs Committee, and its Committee on Migration, Refugees and Demography, for opinion :
5.1. to continue following closely all developments in respect of the right to territorial asylum in Council of Europe member states ;
5.2. to make a study on the legal and political aspects of the right to diplomatic asylum ;
5.3. to report back to the Assembly on these questions if and when they deem fit to do so ;
6. Instructs its Committee on Migration, Refugees and Demography, and its Legal Affairs Committee, for opinion, to study the treatment received by asylum-seekers arriving at European airports and to report back to the Assembly on this issue in due course.
