Strengthening the decision-making process of the Parliamentary Assembly concerning credentials and voting

In the draft resolution, paragraph 10, replace the last sentence with the following sentence: “The members’ rights according to the Rule 35, Rule 39, Rule 43 and Rule 44 shall not be suspended or withdrawn in the context of a challenge to or reconsideration of credentials”.

Explanatory note

The paragraph 10 of the draft resolution stresses that the Assembly’s Rules of Procedure does not list the members’ rights of participation or representation in the activities of the Assembly and its bodies that may be deprived or suspended by the Assembly.

Nonetheless, the proposed clarification of the Rule 10 of Rules of Procedure leaves room for different interpretations of introduced exceptions that leads to legal uncertainty. The best way to clarify the Rule 10 is to setup the exhaustive list of members’ rights with references to relevant articles of the Rules of Procedure that cannot be the subject of a challenge.
