A. Explanatory Memorandum

1.

1. On the 21st April 1956, the Assembly referred to the Special Committee to watch over the interests of European nations not represented in the Council of Europe a motion presented by M. Wistrand and others calling for the release of political prisoners in Eastern Europe. (Document 513).
2. The draft resolution

			See 28th Sitting, 26th October 1956 (Draft Resolution adopted after amendment) and Resolution 107.which is submitted to the Assembly was given a first reading by the Special Committee on 31st August and 1st September 1956.
3. Consultations then took place with the Committee on Legal and Administrative Questions, on the one hand, and with the President of the Assembly, on the other.
4. The draft resolution was adopted by the Special Committee to watch over the interests of European nations not represented in the Council of Europe on 5th October 1956.
5. The lists appended to the draft resolution contain the names of political prisoners from Albania, Bulgaria, Czechoslovakia, Estho-nia, the Soviet Occupied Zone of Germany, Hungary, Latvia, Lithuania, Poland and Rumania about whom no information is available and who must still be presumed in prison.
6. The Special Committee wish to draw attention to the fact that some of the persons whose names are in the list may, as has happened recently, be persuaded by the Soviet authorities to issue statements to the effect that they are no longer detained. It is sometimes difficult in such cases to assess the degree of freedom effectively enjoyed by such persons.
7. It is also desired to point out that the lists are of necessity incomplete.

B. Draft Resolution

The Assembly.

Recalling that the Universal Declaration of Human Rights provides in Article 3 that " everyone has the right to life, liberty and security of person " and in Article 2 that everyone is entitled to this right " without distinction of any kind such as... political or other opinion ";

Considering, furthermore, that Article 9 of the Universal Declaration of Human Rights provides that " no one shall be subjected to arbitrary arrest, detention or exile " and that Article 10 states that " everyone is entitled in full equality to a fair and public trial by an independent and impartial tribunal in the determination of his rights and obligations and of any criminal charges against him ";

Aware that some political prisoners, mostly Communists who were in one way or another allegedly opposed to the rulers of the day, have recently been set free in Eastern Europe, including the U. S. S. R.,

Calls attention to the fact that vast numbers of non-communist political prisoners about whom no information is available must still be presumed in prison;

Emphasises the deplorable fact that many of these people were condemned arbitrarily to long terms of imprisonment or hard labour by administrative decisions, in blatant violation of legality;

Considers that it is the duty of humanity to call for the immediate release of political prisoners in the East, whether fellow-communists or not, and that the response given to this call by the leaders of the U. S. S. R. will be a test of their new intentions;

Invites the President of the Assembly to write to the Prime Ministers of the U. S. S. R. and other Eastern European States within the Soviet orbit requesting information as to the fate and present whereabouts of the persons listed in the Appendix to this Resolution, and transmitting the Assembly's call for the immediate release of political prisoners;

Invites the President of the Assembly to forward this Resolution and the lists appended thereto to the President of the forthcoming session of the General Assembly of the United Nations.

The Bulgarian National Agrarian Union :

Minister of Communications in the Fatherland Front Government, September 1944 to 1945. Reported sentenced to 15 years' imprisonment in February 1952. - Angel DERZHANSKI

Former Deputy Minister of Finance. First arrested in July 1946; released and again imprisoned in June 1947. Alleged to have « confessed » while in jail in 1946 but withdrew confession in the National Assembly before being re-arrested in 1947, stating that any further confessions would be false testimony. Witness in the Petkov trial. Did not appear in trial of his alleged co-plotters. Witness for the prosecution at Gichev trial. - Peter KOEV
Editor of The Agrarian Banner (official organ of the B. N. A. U.) and a member of the Permanent Council of the Party. In Gonda Voda concentration camp under pro-German regime. President of the Union of Bulgarian Writers in 1944. Deputy and member of the Petkov opposition group in 1946. Said to be in Sofia Central Prison from 1947 until mid-1950. Reported re-sentenced to five years' imprisonment in April 1951. - Trifon KUNEV

Leader of the Social Democratic Party and of its representatives in the People's Assembly. Charged with treason and sabotage in November 1948 and sentenced to 15 years' imprisonment. - Kosta LULCHEV
Born 1874. Minister of the Interior in 1939. Leader of the Social Democratic Party and then leader of its Right-wing faction. Arrested early in 1946 and subsequently sentenced to five years' imprisonment. Rumoured to have been killed in prison. No official news of his fate. - Krustyu PASTUHOV

Roman Catholic Bishop of Nikopol (Ruse). Sentenced to death in October 1952. It is rumoured that the sentence was subsequently commuted to life imprisonment, and he is reported to be still in prison. - Mgr. Evgeni BOSILKOW
Apostolic Vicar in Sofia. Sentenced to 20 years' imprisonment at a secret trial in the autumn of 1952. Reported to have since died in prison but no definite confirmation available. - Mgr. Ivan ROMANOV

The 15 Protestant Pastors :

Of the members of the Supreme Council of the United Evangelical Churches in Bulgaria who were tried in February 1949 four were sentenced to life imprisonment, and a fine of one million leva each, with loss of civil and political rights for ever. Two are reported to have been released in 1956 (Nikola MINAILOV and Vasil ZIAPKOV). There is no news about the other two.

Methodist pastor. Head of the Methodist Mission in Bulgaria. Four were sentenced to 15years' severe imprisonment and a fine of 250,000 leva each. - Yanko Nikolov IVANOV

Reached England in May 1940 where he became Minister of State in war-time Government. In 1942 became Minister of Agriculture. In Fierlinger's post-war Cabinet was Under-Secretary for Foreign Trade. Later was Under-Secretary for National Defence, from which post he resigned on February 20th 1948. Sentenced in Bratislava in October 1950 to 17 years' imprisonment on charges of treason and sabotage. - Dr. Jan LICHNER
Active Member of Social Democrat Party and former Professor of Constitutional Law at Prague University. Sentenced on June 8th 1950 to 25 years' imprisonment at espionage trial, at which Mme. Milada Horakova, a National Socialist Deputy, was sentenced to death and later executed by the Communists. - Dr. Zdenek PESICA

Forced to resign in 1947 after the Communists « uncovered » a Slovak « plot » to assassinate the President and overthrow the regime, in which his secretary was allegedly involved. Social Democrat. Formerly chief editor of the Liberec paper Straz Severn (now Cesta Miru). In October i945 was elected to the National Assembly. In June 1949 he was placed under supervision in his palace. In March 1951, he was banished from Prague, fined, and thereafter held in custody for his « negative attitude to the Church laws ». At a press conference on May 24th 1956, the Czech Premier, Siroky, said that Beran was neither in prison nor in custody, but that he <t is not officiating ». The exact conditions under which Archbishop Beran is living are not known. - Mgr. BERAN

Military Personalities :

Security and intelligence chief in the Ministry of the Interior in the London Czechoslovak Government. Shortly after his return to Prague in 1945 he was dismissed from his post under Communist pressure. Immediately after the putsch he was arrested and thrown into prison. Nothing is known of his trial, if any, and opinions differ as to the length of sentence imposed upon him.

Commander-in-Chief of Czech Air Force in Great Britain during war. Was arrested while trying to escape from Czechoslovakia in 1948 and sentenced to death. Sentence later commuted to life imprisonment. There have been rumours that he committed suicide. Other reports claim that he has been seen in one of the prisons.

Resistance leader. Sentenced to life imprisonment on May 16th 1949. Relative of the Czech night-fighter ace of that name in the R. A. F. during the war. There have been rumours that Kutlvasr was beaten to death in prison, but this is not confirmed.
